Terms and Conditions (Refund and Returns Policy)

These Terms and Conditions (“Terms”) govern your use of www.charlotteabraham.art (the “Website”) and any purchases of goods or services from me, Charlotte Snipe (“I”, “me”, “my”, “the Artist”).

By accessing the Website or placing an order, you agree to these Terms. If you do not agree, do not use the Website or place orders.

I am the seller and data controller. My contact details are: Email: charlotteabrahamart@gmail.com.

These Terms form a legally binding contract between you and me when you place an order.

1. Use of the Website

You may use the Website for personal, non-commercial purposes only. You must not misuse the site (e.g. introduce viruses, attempt unauthorised access).

All intellectual property rights in the Website and its content (including images of artwork) belong to me or my licensors. You may view content for personal use but may not reproduce, distribute, or commercially exploit it without permission (except as allowed for sharing purchased prints under separate licence if applicable).

2. Orders and Formation of Contract

  • All orders are offers to buy. I may accept or reject them (e.g. if out of stock, pricing error).
  • A contract forms when I send you an Order Confirmation email.
  • Prices are in GBP, include VAT where applicable, but exclude delivery (shown separately at checkout).
  • I reserve the right to change prices, but changes do not affect confirmed orders.
  • Payment is via [Stripe/PayPal/etc.]. Full payment is required before dispatch (unless deposit agreed for commissions).

3. Delivery

  • I aim to dispatch within 5 working days of order confirmation (or longer for made-to-order items — see product page).
  • Delivery times are estimates. Risk passes to you on delivery.
  • Title (ownership) passes when full payment is received.
  • For international orders, you are responsible for customs duties/taxes.

4. Your Consumer Rights

As a consumer buying at a distance (online), you have rights under UK law, including the Consumer Rights Act 2015 and Consumer Contracts Regulations 2013.

Goods must be:

  • As described
  • Of satisfactory quality
  • Fit for purpose

If goods are faulty/not as described, you may be entitled to repair, replacement, price reduction, or refund (see section 5).

5. Refunds and Returns Policy

This policy applies to purchases made through the Website.

5.1 Change of Mind (Cooling-Off Right)

For most goods bought online, you have a 14-day cooling-off period under the Consumer Contracts Regulations 2013. You may cancel for any reason from the day you place the order until 14 days after you (or someone you nominate) receive the goods.

To cancel:

  • Inform me in writing (email is fine) within 14 days of receipt.
  • Return the goods within 14 days of notifying me, in original condition/packaging, unused, with all tags/labels.
  • You must pay return postage costs (unless faulty — see below).
  • I refund the full price paid (including standard delivery costs) within 14 days of receiving the returned goods (or proof of return, e.g. tracking). Refunds use the original payment method.
  • I may reduce the refund if the goods show handling beyond inspection (e.g. damage caused by you).

Exceptions — No Cooling-Off Right The 14-day cancellation right does not apply to:

  • Bespoke or personalised goods (made to your specification) — e.g. commissioned portraits, artwork with your chosen subject/size/elements, custom-framed items, or prints personalised with names/dates.
  • Made-to-order goods clearly described as such on the product page.

5.2 Faulty, Damaged, or Not as Described Goods

If goods arrive damaged, faulty, or not as described:

  • Contact me within a reasonable time (ideally within 14–30 days of receipt, with photos if possible).
  • Under the Consumer Rights Act 2015, within the first 30 days you are usually entitled to a full refund; after that, repair/replacement may apply first.
  • You do not pay return costs for faulty/not-as-described items — I will arrange collection/reimbursement where reasonable.
  • Refunds (including delivery costs) issued within 14 days of return/inspection.

5.3 Non-Returnable Items

  • Digital downloads (if any) lose cancellation rights once accessed/downloaded (with your consent).
  • Gift vouchers/certificates (if non-redeemable).
  • Items clearly sold “as seen” or reduced due to defects (notified pre-sale).

5.4 How to Return

  • Package securely in original materials to prevent damage.
  • Include order number and reason.
  • Use tracked/signed-for postage (keep proof).
  • You will receive confirmation of the return address during this process

6. Commissions and Made-to-Order Work

  • Commissions require agreement on price, specs, deposit of 50% (non-refundable once work begins), and timeline.
  • Deposits are non-refundable if you cancel after work starts (due to bespoke nature).
  • Final payment due on completion/approval.
  • No cooling-off right applies to true bespoke commissions.

7. Limitation of Liability

  • I am not liable for indirect losses (e.g. loss of profits).
  • Liability is limited to the price paid, except for death/personal injury caused by negligence or fraud.
  • Nothing affects your statutory rights.

8. Events Outside My Control

I am not liable for delays due to force majeure (e.g. strikes, extreme weather, pandemics).

9. Governing Law and Disputes

These Terms are governed by English law. Disputes are subject to the non-exclusive jurisdiction of English courts.
If you have a complaint, contact me first. If unresolved, use the EU Online Dispute Resolution platform or seek advice from Citizens Advice.

10. Changes to These Terms

I may update these Terms. Changes apply to new orders; continued use constitutes acceptance.
